What this means
Start with the exact decision in front of you.
Under ICAEW's current framework, assessment and investigation can lead to allegations before the Conduct Committee and, where appropriate, referral of formal allegations to a Tribunal. Cooperation obligations and current regulations should be checked directly.
Immediate priorities
Organise the position before responding.
Identify the applicable framework and commencement date
Answer information requests fully and on time
Prepare evidence against each proposed allegation

01
Use the correct ICAEW framework
ICAEW's current disciplinary framework separates core Disciplinary Bye-laws from process provisions in the Investigation and Disciplinary Regulations. Transitional rules matter for older cases, so identify when the complaint entered the process and which version applies. Record whether the subject is a member, firm, affiliate or other relevant person. The Conduct Department assesses complaints, investigates conduct matters and prepares allegations for the independent committee structure defined in the framework.
Assessment asks whether there may be liability to disciplinary action and whether investigation is appropriate. Not every fee dispute, service complaint or mistake amounts to misconduct. If ICAEW opens an investigation, identify the specific professional standard, bye-law or duty relied upon. Respond to the alleged conduct and the jurisdictional basis separately. A complaint's origin or emotional force does not replace evidence of a breach serious enough for disciplinary treatment.
- Confirm the applicable post-2023 or transitional rules
- Identify member, firm and relevant-person status
- Separate service complaint from potential misconduct
02
Cooperate without sacrificing precision
ICAEW's framework imposes duties to cooperate and provide specified information. Answer requests promptly and fully, even where the complaint appears unfounded, because non-cooperation can become a separate disciplinary issue. Break each request into documents, explanation and confirmation, then log the response. If material cannot be obtained, describe searches and custody. If a deadline is unrealistic, seek an extension before it passes with a proposed delivery plan.
A written response should give a position on each proposed allegation and connect it to source records. Distinguish an accounting judgment based on the information then available from a documentation failure or later-known event. Where expert technical analysis is used, disclose assumptions and applicable standards. Remediation, revised quality controls and training may be relevant to outcome, but they do not answer whether the historical allegation is proved. Keep those parts of the submission distinct.
- Respond even where the complaint is disputed
- Log searches, production and missing material
- Separate historical breach from later remediation
03
Prepare for the Conduct Committee decision
The Conduct Committee considers allegations reported under the current framework and may reach outcomes within its powers or refer formal allegations for a Tribunal hearing. Obtain the allegation wording and material to be considered. Check whether facts, misconduct and proposed outcome are expressed separately. A concise allegation schedule can show admissions, disputes and supporting documents, while a proportionality section addresses any proposed sanction without implying acceptance of contested liability.
If the matter proceeds to a Tribunal, the formal allegation and tribunal rules control the next stage. If it concludes by consent or another committee outcome, review the exact admissions, sanction, costs and publication. ICAEW's current sanctions guidance and amended regulations should be checked at the date of decision. Preserve the final reasons and identify any review or appeal route immediately; an internal disagreement does not automatically extend the filing period.
- Audit the allegation placed before the committee
- Address liability and sanction separately
- Secure reasons, publication terms and appeal information
Key questions
Keep the analysis tied to this stage.
Whether there is potential liability to disciplinary action
What outcome the Conduct Committee may reach
Whether a formal allegation should proceed to a Tribunal
Advice is provided only by the regulated firm that accepts a matter.
Common questions
Clarifying the route without assuming the outcome.
Do I have to answer ICAEW if I believe the complaint is vexatious?
ICAEW's member guidance says subjects should respond to information requests despite that view. Cooperation obligations are distinct from the merits, and ICAEW can assess whether a complaint should proceed.
Who makes ICAEW disciplinary decisions?
The Conduct Department assesses and investigates, while independent committees perform the decision functions assigned by the current disciplinary framework. The precise committee depends on the stage and issue.
