CILEX Regulation guide · CILEX disciplinary hearing defence and sanctions

Preparing for a CILEX Disciplinary Tribunal hearing

The Disciplinary Tribunal holds a formal public hearing at which CILEX Regulation must prove alleged misconduct. If an allegation is proved, the Tribunal separately considers sanctions, possible fine, costs and, for an entity, practice-management protections.

What this means

Start with the exact decision in front of you.

The Disciplinary Tribunal holds a formal public hearing at which CILEX Regulation must prove alleged misconduct. If an allegation is proved, the Tribunal separately considers sanctions, possible fine, costs and, for an entity, practice-management protections.

Immediate priorities

Organise the position before responding.

01

Audit the allegations, directions and hearing bundle

02

Prepare witnesses around admissible first-hand evidence

03

Plan separate submissions on proof, sanction and costs

Detailed guidance

The procedure, evidence and possible route from here.

01

Define the public Tribunal case

The Disciplinary Tribunal holds formal public hearings and decides whether CILEX Regulation proves the misconduct alleged. Start with the formal allegation and procedural notice, then separate admitted facts, contested evidence and the Code breach said to follow. A PCP referral is not proof. Check that any direct referral by an Investigator satisfies the rule relied on and that the respondent has a fair opportunity to answer the case actually advanced.

Create a directions calendar covering the response, witness statements, documents, preliminary applications and hearing. If the respondent is an entity, identify the authorised representative and how individual evidence will be presented. Raise conflicts, privilege, accessibility, health or adjournment issues as soon as possible. Non-attendance can lead to proceedings continuing, so inability to attend should be supported and addressed through a timely application rather than silence.

  • Map each formal allegation and Code provision
  • Calendar every Tribunal direction
  • Raise hearing and representation issues promptly

02

Prepare proof and witnesses

CILEX Regulation bears the burden of proving misconduct under the Enforcement Rules. Test documents for authenticity, completeness and the propositions they support. Court judgments and prior disciplinary determinations may have a specified evidential effect, so examine the exact instrument rather than attempting to relitigate a conclusive fact through collateral evidence. Other reports or allegations may remain open to challenge on reliability and relevance.

Prepare witnesses from first-hand knowledge and contemporaneous records. A client can describe instructions and communication, a supervisor can explain systems and oversight, and an expert may address a defined professional issue; their roles should not blur. If a statement contains hearsay or inference, identify it and assess weight. The respondent's evidence should acknowledge limits of memory and distinguish current reconstruction from notes made at the time.

  • Apply the correct burden and evidential status
  • Prepare each witness for their proper role
  • Distinguish contemporaneous record from reconstruction

03

Prepare separately for sanction and costs

If misconduct is proved, the Tribunal may consider warning, reprimand, conditions, exclusion, fine, costs and, for an entity, practice-management provisions within its powers. Prepare mitigation and remediation without assuming an adverse result. Evidence should connect directly to the finding: audited account controls, undertaking registers, supervised files or revised conflict systems can demonstrate sustained professional change more clearly than generic testimonials alone.

Obtain the formal decision, reasons and order, including when it takes effect. A respondent absent and unrepresented may have a distinct rehearing provision with a short period, while an appeal follows Part IV of the Rules. Review publication, certificate return, employment and entity-authorisation consequences immediately. Preserve the hearing record because later grounds should be based on what the Tribunal decided, not a summary from another participant.

  • Prepare finding-specific mitigation
  • Address fine, costs and entity protections
  • Secure the order and challenge timetable
