Classify material before asserting privilege
Legal advice privilege generally protects confidential communications between lawyer and client made for giving or receiving legal advice. Litigation privilege may protect qualifying communications and material produced for the dominant purpose of conducting adversarial litigation that is in progress or reasonably contemplated. The label 'for the lawyer' does not create privilege. A rota, clinical note, bank record, message or employer report that already existed ordinarily remains an underlying record even after it is sent to a criminal solicitor.
Privilege belongs to the client, and an uninformed summary or attachment can waive protection over material that is disclosed. Confidentiality is related but different: information can be confidential without being legally privileged. Before answering a regulator, create a document list that identifies source, author, date, purpose, recipient and proposed privilege basis. Mixed communications require close attention because operational, public-relations and legal purposes may coexist. Seek specific advice where status is doubtful rather than making an unsupported blanket claim over the whole file.

Answer the regulator's request without accidental waiver
Read the request for its statutory or rule-based authority, categories, date range and deadline. Identify responsive non-privileged documents and any objection based on relevance, proportionality, confidentiality or another legal restriction. Where privilege is properly claimed, describe the category and basis sufficiently to permit the issue to be understood without revealing the protected advice. Ask for a short extension or a staged response if a defensible review cannot be completed safely within the original timetable.
A regulator may seek a factual account while a criminal case is live. That does not automatically require disclosure of the defence solicitor's advice, attendance note or draft strategy. A response can explain verified events, identify documents held independently and reserve a position on disputed allegations. If the regulator challenges a privilege claim, use its procedural route and obtain advice on the specific material. Do not copy privileged text into an ostensibly non-privileged letter, because the substance rather than the heading determines the risk.

Coordinate accounts while protecting the criminal defence
Maintain separate folders for original evidence, regulatory correspondence, employer material and confidential legal advice. The factual chronology used to check consistency can refer to the existence and date of advice without recording its substance. Before sharing a draft response with an employer, indemnifier or other adviser, confirm who the client is, why the recipient needs it and whether confidentiality will be preserved. Broad circulation can make later privilege arguments harder even when everyone is concerned with the same incident.
Consistency means describing the same verified fact accurately; it does not mean copying one process's statement into every forum. A police interview addresses suspected offending, while a regulator may ask about professional standards, current risk or remediation. Draft the regulatory account for that test and check it against prior recorded answers. If answering now could create concrete unfairness in the criminal case, explain the overlap and propose focused case management rather than ignoring the regulator or relying on privilege as a reason to provide nothing.
