The 2026 sanctions policy explains that sanction is protective rather than punitive, although its effect can be severe. The panel considers public safety, public confidence and proper professional standards, then evaluates the available outcomes proportionately. Content should not present a caution, conditions, suspension or striking off as an automatic result of a particular allegation. Seriousness includes more than the immediate outcome of an incident. The panel may consider culpability, harm or risk, repetition, abuse of trust, vulnerability, professional boundaries and the wider effect on confidence. Insight must be demonstrated, not declared

Insight usually involves recognising what went wrong, the effect on others, the professional standards engaged, the reasons it happened and the safeguards needed to prevent repetition. It can develop over time and may be expressed differently across cultures, communication styles and neurodivergence. The revised HCPC policy asks panels to consider different ways apology or insight may be shown, so polished language should not be confused with genuine understanding. The current notice and official process remain the controlling reference points for that assessment.

A reflective account is strongest when it is accurate about disputed and admitted facts. It can acknowledge risk or impact without accepting a proposition that the evidence does not support. Repeated claims that a process is unfair, with no engagement with the underlying professional issue, may weaken the account. Equally, a forced apology can be misleading. Use concrete examples of changed decision-making, escalation, documentation, boundaries or supervision to show how insight affects practice.

Remediation should match the identified concern

Different concerns require different evidence. A competence issue may call for supervised practice, assessment and audit; a record-keeping issue may require sampling and review; a boundary concern may require specific training, supervision and behavioural evidence. Completing an unrelated course adds volume but little assurance. Set out the original weakness, the intervention, who evaluated it, the period over which change was observed and the result. Any response should connect this point to the documents and decision actually under consideration.

Some conduct is harder to remediate or engages public confidence beyond recurrence risk. That does not make evidence irrelevant, but it changes what the panel must evaluate. Testimonials should come from people who know the concern and can describe observed practice rather than simply assert good character. Where time or restricted practice has limited remediation, say so and present a credible, measurable plan instead of implying that work has occurred when it has not.
