Why a bridging order may be considered

A final conditions, suspension, erasure or striking-off decision may not take effect immediately because the professional has a statutory appeal period and, in some regimes, a lodged appeal delays the substantive order. If the panel considers unrestricted practice unsafe during that gap, it may have power to impose an interim or immediate order. This is a separate decision requiring its own statutory basis, submissions and reasons, even when its terms mirror the substantive outcome.

NMC guidance expressly describes interim orders after sanction to cover the 28-day appeal period and any appeal. MPTS guidance distinguishes immediate orders that bridge the doctor's appeal period. GDC Practice Committee guidance addresses immediate conditions or suspension, and HCPTS guidance addresses interim protection after a substantive decision. The labels are not uniform, so content should describe the function first and then use the exact regulator term. Each route has different statutory language and commencement rules.

The panel must assess risk during the gap

The fact that a restrictive final sanction was imposed does not remove the need to consider the temporary order. The panel assesses whether immediate protection is necessary, otherwise in the public interest or, where the statute permits, in the professional's interests during the appeal period. Its findings and sanction reasons will be highly relevant, but the duration and form of the bridging measure still require explanation and a proportionate connection to the identified risk.

Parties may make focused submissions on whether no order, conditions or suspension is required before the substantive outcome begins. If the final finding concerns remediable clinical risk, immediate conditions may be considered where they can operate. If erasure or suspension was selected because conditions were insufficient, an inconsistent temporary proposal needs careful explanation. Public-confidence findings can also support an immediate restriction even where direct patient risk is not the sole basis.

Appeal, expiry and interaction with existing orders

The bridging order may continue until the substantive order takes effect or an appeal is finally resolved, subject to the precise statute and decision. A filed appeal can therefore extend the period during which the temporary order matters. The professional should calendar service, appeal and expiry dates and check the register after any court decision. Withdrawal, dismissal or success on appeal can change which order is operative. The written determination should explain that endpoint precisely.

An earlier investigation-stage interim order may lapse, be revoked or require review when the final case concludes, particularly where multiple referrals remain. NMC publishes detailed guidance on that interaction. The panel's decision should be read alongside any other live case or restriction because one concluded referral does not necessarily remove an order supported by separate unresolved concerns. The operative position should be confirmed from the latest formal documents rather than inferred from a headline final outcome.
