SIA guide · SIA licence appeal to the Magistrates' or Sheriff Court

Appealing an SIA refusal, suspension or revocation

A licensing appeal is made to the court identified by the governing Act and decision notice, not through the SIA complaints process. The route, 21-day period and court procedure require prompt checking, and an appeal does not make a suspended licence usable.

What this means

Start with the exact decision in front of you.

A licensing appeal is made to the court identified by the governing Act and decision notice, not through the SIA complaints process. The route, 21-day period and court procedure require prompt checking, and an appeal does not make a suspended licence usable.

Immediate priorities

Organise the position before responding.

01

Preserve the decision letter and proof of its effective date

02

Confirm the correct court, form, fee and filing deadline

03

Prepare evidence and grounds around the licensing criteria

The procedure, evidence and possible route from here.

01

Start with the statutory forum and deadline

The Private Security Industry Act and SIA decision notice identify the court route for appealing refusal, modification, suspension or revocation. Depending on jurisdiction, this may be a Magistrates' Court or Sheriff Court. The SIA's published guidance refers to a 21-day period for relevant licence decisions, but calculate it from the event specified in the actual letter and current law. A general complaint to the SIA does not lodge the appeal.

Secure the decision, reasons, licence record and proof of the effective date. Contact the court for the correct procedural form, filing method, fee and service requirements without waiting for the full merits case to be perfected. If the deadline may have passed, obtain case-specific advice on jurisdiction and any power to extend rather than assume late papers will be accepted. Keep stamped or acknowledged filing evidence.

  • Confirm the correct court jurisdiction
  • Calculate the statutory period from the notice
  • Keep formal proof of valid filing

02

Build grounds around the licensing decision

Organise the appeal by the criterion or statutory ground the SIA applied. Identify factual errors, unreliable information, incorrect categorisation, relevant mitigation and the decision the court is asked to make. Attach authoritative records and a clear, dated chronology. An employment grievance or attack on the regulator's motives does not replace evidence showing why the licensing conclusion should change under the governing test.

Prepare witnesses only where they add admissible, relevant evidence. A court may need the licence holder to explain events, an employer to describe controls, or an official record to correct data. Provide each witness with the decision and the particular issue, and do not script identical accounts. If criminal proceedings are live, coordinate evidence carefully so the licensing appeal does not prejudice the defence or breach reporting restrictions.

  • Tie every ground to the criterion applied
  • Use primary records and a neutral chronology
  • Coordinate witnesses with parallel criminal proceedings

03

Understand the position pending appeal

An appeal does not permit work under a suspended licence; the SIA expressly states that suspension remains effective during appeal. Check the legal effect of refusal, modification or revocation from the decision and Act rather than assuming the same rule for every category. Notify the employer accurately and arrange non-licensable duties only where those duties genuinely fall outside licensing requirements.

After the court determines the appeal, obtain the sealed order and send any required copy to the SIA. Verify that the public register reflects the outcome before returning to licensed activity. If the appeal is dismissed, read whether any further challenge exists and its basis; a higher-court route usually concerns legal error rather than a fresh licensing merits hearing. Continue compliance until a competent body changes the decision.

  • Observe the current decision throughout appeal
  • Obtain and serve the court order
  • Verify the register before resuming work
