Identify the status of the SRA contact

An email or letter from the SRA can record a report, request preliminary information, confirm that an investigation has opened, or give formal notice before a decision. Those stages carry different consequences. Read the heading, reference, attachments and cited rule together. Record who is named as the regulated person, whether a firm is also involved, what conduct is described and the exact date for reply. An initial report is not a finding, and an investigation notice does not prove a breach.

The SRA's assessment threshold asks whether the reported facts could amount to a breach, whether the possible breach is serious enough to justify regulatory action, and whether it appears capable of proof. A service complaint may belong with the Legal Ombudsman unless the information also raises a serious regulatory issue. A first response should therefore identify the regulatory proposition rather than adopting a client's characterisation or arguing every aspect of the underlying service dispute.

Preserve the record before giving an account

Secure the correspondence, client file, supervision records, finance material, emails and system audit data that may bear on the report. Preserve each source in its existing form and note where it is held. Do not add to an attendance note, replace a document or tidy metadata after the event. A separate working chronology can identify reliable dates, gaps and areas of uncertainty without changing the underlying record. Preservation should be proportionate but should begin before routine deletion continues.

A solicitor may face connected employment, partnership, insurer, police, civil, anti-money-laundering or other regulatory processes. Map those processes and their deadlines before recycling a statement from one forum into another. The legal questions may differ even where the documents overlap. Identify who owns any privilege, who controls the file and whether disclosure restrictions apply. These issues call for accurate handling, not concealment; any limit on production should be raised transparently through the proper procedure.

Protect the immediate professional position

Check the firm's internal reporting arrangements, employment terms and professional indemnity notification requirements. The SRA will usually tell an employer when it investigates an individual, subject to the public-interest exception in its rules, so an orderly internal plan is preferable to surprise disclosure. Notification does not require an untested admission. It should accurately describe the status of the matter, preserve confidentiality where possible and identify who will coordinate responses for the person and the firm.

Most investigations are conducted through documents, but the SRA can consider on-site work, interviews or interim controls where the circumstances justify them. Do not assume that contact automatically prevents practice, and do not ignore language suggesting urgent protective action. Verify any restriction against the actual decision or practising-certificate condition. Where the notice raises client money, dishonesty, document integrity or immediate client risk, the timetable and need for independent advice may be particularly acute.

Does an SRA investigation mean professional misconduct has been found?

No. An investigation gathers and tests information. A disciplinary finding requires the relevant decision-making process, and an SDT referral remains an allegation until the independent tribunal determines it.

Should I answer the reporter's whole complaint in my first reply?

Address what the SRA has actually requested at the stage and by the stated date. A complete defence prepared before the issues and evidence are clear can create avoidable inconsistency or distraction.
