Confirm that the TRA process applies

The Teaching Regulation Agency handles serious teacher misconduct for the Secretary of State in England. It does not replace a school's complaints process or decide every employment dispute. Read the referral notice for the teaching role, institution, dates and alleged behaviour in scope. Confirm that the person and work fall within the relevant legislation. A referral can be made after resignation or dismissal, so the end of employment does not automatically remove regulatory jurisdiction.

TRA guidance describes serious misconduct as conduct that could justify preventing a person from teaching. Examples can involve safeguarding, violence, sexual misconduct, serious dishonesty, discrimination or other behaviour capable of engaging professional confidence, but a label in a referral is not a finding. Separate the reported event, any local conclusion and the regulatory question. The TRA must decide whether the information should close, be investigated further or proceed toward a professional conduct panel.

Secure the referral and local record

Preserve the referral correspondence, employer investigation, safeguarding records, policies, emails and relevant pupil or personnel material through lawful channels. Do not take confidential records from school systems without authority or amend an original note. Create a separate chronology showing which source supports each event and where the teacher's recollection differs. If the TRA lacks an important document, identify it and the lawful custodian rather than asserting what it must contain.

An employer's finding may be relevant evidence but it does not automatically determine the TRA outcome. Check the local process, witness material, reasons and any appeal. Identify whether allegations were admitted, proved, withdrawn or left unresolved. If the referral summary compresses or changes the local allegation, make that visible. The regulatory response should deal with the TRA's current question while explaining material limits in the record on which the referral relies.

The same events may involve the police, local authority designated officer, Disclosure and Barring Service, employer, civil claim or another professional body. Record each process, decision-maker and deadline. They apply different statutory tests and can reach different outcomes. A decision not to prosecute does not automatically resolve professional regulation, just as an employment finding does not itself establish serious misconduct for the Secretary of State.

Statements and documents can move between processes, so accuracy matters from the first response. Do not coordinate witness accounts or approach a pupil, parent or colleague contrary to safeguarding or employer directions. Check union, insurer and employment notification terms. If immediate pupil-protection concerns are alleged, determine whether an interim prohibition is being considered and address that timetable separately from the final investigation. An interim decision is protective and does not prove the allegations.

Yes. Ending employment does not necessarily end the Secretary of State's teacher-misconduct jurisdiction. The TRA process concerns suitability to undertake teaching work in England, not only the former contract.

No. The TRA considers scope, evidence and seriousness under its process. Some matters close or remain employment issues, while sufficiently serious cases may be referred onward.
