DBS barring guide · DBS barring representation evidence

Evidence for DBS barring representations

Useful evidence connects directly to the facts, safeguarding risk and changes since the event. Generic references may provide context but rarely answer every statutory issue by themselves.

What happens if I ask for an introduction?

Before any details are shared, the live service will name the recipient and ask for your consent. The independent regulated firm will decide whether it can help and provide its own terms.

What this means

Start with the exact decision in front of you.

Useful evidence connects directly to the facts, safeguarding risk and changes since the event. Generic references may provide context but rarely answer every statutory issue by themselves.

Immediate priorities

Organise the position before responding.

01

Create an evidence matrix against each disputed or risk issue

02

Obtain specific references from people with relevant knowledge

03

Explain treatment, training or changed circumstances with supporting material where appropriate

01

Start with an evidence matrix

List each DBS provisional finding, the source relied upon, the person's position and the best supporting or correcting evidence. Primary records such as court documents, employer investigation material, contemporaneous messages and verified treatment records generally require different weight from recollection or character opinion. The matrix prevents repetition and identifies genuine gaps. It also helps distinguish a disputed fact from a fact that is established elsewhere but whose safeguarding significance remains contested.

Check authenticity, date and completeness before relying on a document. A cropped message, unsigned statement or selective extract can mislead even when not deliberately altered. If a source contains third-party or sensitive information, use the submission route specified by DBS. Explain any necessary redaction. Do not obtain records through improper contact with an alleged victim, child, vulnerable adult or witness; evidential urgency does not override safeguarding or confidentiality. That distinction prevents a general explanation from being mistaken for case-specific legal advice.

  • Map every finding to its source and response evidence
  • Verify provenance and completeness
  • Protect safeguarding and confidentiality when obtaining material

02

Risk evidence must address the future

Barring is concerned with protection from future harm in regulated activity, so evidence should do more than describe punishment already suffered. Relevant material may include specialist risk assessment, treatment progress, relapse-prevention planning, boundary work, supervision, employment history and a sustained period without recurrence. The weight depends on whether the assessor or referee knew the full relevant history and used a method suited to the risk question. A dated, source-linked case file helps preserve that distinction as the matter develops.

Training and insight matter when they produce demonstrable change. Explain the original risk factors, warning signs, decisions now made differently and safeguards available if pressure returns. Avoid formulaic claims of remorse or rehabilitation. DBS may be more assisted by a specific account of responsibility and risk management than by a broad statement that the event was out of character. Where risk remains, acknowledge it and show how it is controlled.

  • Use evidence that examines present and future safeguarding risk
  • Disclose relevant history to specialists and referees
  • Show changed decisions and safeguards, not labels alone

03

References should be informed and specific

A useful referee explains how they know the person, what they understand about the concern, the period of observation and concrete conduct relevant to risk. A generic statement that someone is kind or hardworking may provide context but does not address safeguarding. Where a referee knows only a summary, state that limitation. Several repetitive references do not become independent risk evidence merely through volume. Keeping that question separate makes the resulting submission clearer and more reliable.

Present employment consequences separately from the legal assessment. Loss of career, income or reputation can be profound, but hardship alone does not answer whether barring is appropriate. Evidence about a proposed role can matter where it clarifies regulated activity, safeguards and future opportunity. The submission should remain honest about what the person seeks to do and should not minimise contact with vulnerable groups to obtain a favourable outcome. The record should show how this point applies, rather than asking the decision-maker to assume it.

  • Ask referees to state their knowledge and observations
  • Avoid repetitive generic character material
  • Explain proposed regulated activity and safeguards accurately

Key questions

Question 01

Accuracy of the underlying facts

Question 02

Current and future safeguarding risk

Question 03

Weight, independence and relevance of supporting evidence

Independent legal help

Advice is provided only by the regulated firm that accepts a matter.

Common questions

Clarifying the route without assuming the outcome.

What makes a strong DBS character reference?

It should be specific, informed about the concern and based on meaningful observation. Generic praise from someone unaware of the relevant history may carry limited weight.

Is completing a course enough to prove reduced risk?

Not by itself. Explain what was learned, how behaviour changed and what objective evidence shows that the change is sustained and relevant to the safeguarding concern.
