Triage, provisional enquiry and investigation are distinct

The GMC first considers whether information about a doctor may put patient safety, public confidence or professional standards at risk. Some matters can close at triage. Where evidence is unclear, a provisional enquiry may obtain limited, targeted information before the GMC decides whether to open a full investigation. A provisional enquiry is therefore not simply a shorter full investigation, and its request should be answered around the specific uncertainty the GMC is testing.

A full investigation gathers the evidence needed for an end-of-investigation decision. Depending on the concern, that may include clinical records, employer material, expert opinion, health or performance assessment and the doctor's response. Identify the route named in the latest correspondence and do not assume that terminology used by an employer describes the GMC stage accurately. Record what the regulator already holds, what it seeks and who may receive information. Keeping that question separate makes the resulting submission clearer and more reliable.

Respond proportionately to the question being asked

A targeted enquiry may be resolved by a clear record, current employer information or an explanation of context. Sending an unfocused defence bundle can obscure the question and introduce sensitive or irrelevant material. Create a concise chronology, identify the precise fact or risk in issue and select documents that answer it. Preserve originals and distinguish contemporaneous records from a later explanatory statement or reflection. A dated, source-linked case file helps preserve that distinction as the matter develops.

If the case becomes a full investigation, revisit the response plan rather than merely expanding the earlier letter. The GMC may now be considering broader allegations or current fitness to practise. Coordinate any employer, responsible-officer, coroner, police or criminal process because statements and findings may be shared. Consistency means being accurate across forums; it does not mean using identical submissions where the legal question and audience differ. Its practical significance must still be assessed against the individual evidence and procedural stage.

Know the possible next decisions

A full investigation can close with no action, lead to a warning, produce an invitation to agree undertakings or be referred for a Medical Practitioners Tribunal hearing, depending on the evidence and applicable powers. A separate application to an Interim Orders Tribunal may be made where temporary restriction is said to be necessary. These routes have different tests and effects, so avoid treating any continued investigation as inevitable tribunal referral.

The GMC assigns an officer during a full investigation and provides information about support and reasonable adjustments. Procedural engagement should be recorded, particularly requests for missing material, adjustments or time. Once the evidence-gathering stage ends, the doctor will need to understand what material the decision-makers will consider and how to address facts, context, current risk and remediation. Early file discipline makes that later response more reliable. That distinction prevents a general explanation from being mistaken for case-specific legal advice.
