Frame the Stage 2 realistic-prospect question

Stage 2 PIC examines the fuller investigation to decide whether there is a realistic prospect of proving facts that amount to serious professional misconduct, or a conviction basis showing unfitness to practise, and whether disciplinary referral is in the public interest. The committee evaluates weight but does not hear and resolve witness conflicts as a trial tribunal. Start with the proposed concern and identify separately the evidence for the facts, the seriousness threshold and public interest. A strong response follows those components rather than repeating the Stage 1 narrative unchanged.

Review the complete material, including veterinary investigator reports, expert opinions, witness statements and any response from the person who raised the concern. List missing underlying records and assumptions. Because RCVS says the Disciplinary Committee applies its demanding current proof standard, Stage 2 should not refer a case certain to fail. At the same time, this is not an opportunity to demand that the PIC decide every credibility conflict finally. Show whether reliable evidence capable of proof exists and whether the alleged conduct, taken at its realistic height, crosses the serious threshold.

Use context and mitigation for the decision they affect

Circumstantial context may alter seriousness: urgency, information reasonably available, harm or risk, repetition, financial motive, concealment and breach of trust can all matter. Personal history and testimonials usually have a different role. Organise them separately so a good career is not advanced as proof that an event could not occur. Where facts are admitted, give a clear account of insight and remediation. Where they are disputed, explain learning that is possible without adopting an inaccurate allegation.

Stage 2 can consider whether health or performance concerns are better managed through the relevant protocol, including proportionate undertakings and monitoring, where the public interest permits. Any proposed undertaking should be targeted, workable, measurable and compatible with actual employment. Provide supervisor consent, reporting intervals and an exit or review mechanism. Breach or non-cooperation can itself create serious difficulty, so never offer a condition simply to avoid referral. Especially grave or incompatible conduct may require a Disciplinary Committee decision despite subsequent improvement.

Prepare for every available disposition

Depending on its assessment, Stage 2 may close with no further action, close with formal advice, refer an appropriate matter for a Charter Case warning, manage qualifying concerns under a protocol, or refer charges to the relevant Disciplinary Committee. Read the current RCVS material for the exact case. A closure does not decide a civil or employment dispute, and a referral does not establish the charge. Obtain the written reasons, the concern or charge formulation and any continuing request or undertaking.

If disciplinary referral is directed, move promptly from broad correspondence to hearing preparation. Secure the final investigation file, proposed charges, expert material and primary records; identify witnesses and preserve availability. Check whether the respondent is a veterinary surgeon or veterinary nurse because the statutory and rule routes differ. If the case closes or proceeds by advice or warning, implement any relevant professional learning and describe the outcome accurately. Keep publication, confidentiality and employer notification questions separate from what Stage 2 itself decided.
