This is a screening judgment, not a conclusion that the architect is guilty. The written reasons should identify which allegations pass that test. This exercise often reveals where a broad preliminary concern needs formal clarification before a fair hearing. Raise proposed amendment or ambiguity through case management rather than waiting until oral evidence begins.
Review the investigation record for material that supports the architect as well as ARB's case. Confirm whether an Inquirer or other expert may give evidence and obtain the report and instructions. Prepare for public adjudication
PCC hearings are ordinarily public and outcomes are published. Consider early whether an application concerning privacy, confidential project material, vulnerable witnesses or health evidence is needed. The presence of commercially sensitive information does not by itself mean the entire case will be private. Propose targeted, evidenced measures that protect necessary information while respecting open justice and ARB's public regulatory function.
Inform insurers, employers or practices as required, but describe the position accurately: a case-to-answer decision is a referral, not an adverse finding.
