Build a controlled document record

Both parties are expected to exchange the documents they intend to rely upon in accordance with the disciplinary procedure and Notice of Hearing. Create an index showing date, author, source, relevance and any confidentiality issue. Keep a clean original of each document and identify any redaction or later annotation. If a required record is held by a school or third party, request it early and record the response rather than assuming the panel will obtain it.

Late documents may require an application and a panel ruling. Explain why the material is relevant, when it became available and what opportunity the other party needs to respond. Do not hide a difficult document until the hearing; that can disrupt fairness and credibility. Where a document contains pupil, health or safeguarding information, propose proportionate handling such as redaction or a private segment without removing context necessary to decide the allegation.

Prepare witnesses around their own evidence

A witness statement should be signed, dated and explain the witness's role and direct knowledge. Separate what they saw or heard from information obtained later. Use contemporaneous records to check dates, but do not ask a witness to adopt another person's language or remove uncertainty. If the witness's memory has changed, the statement should explain the source of any refreshed recollection. Credibility is assisted by candour about limits.

A party intending to call a witness should follow the attendance and exchange directions. TRA guidance provides for applications where attendance, vulnerability or special measures require a ruling. Identify the functional need and proposed arrangement. Questioning should test disputed evidence without intimidation, and the panel or legal adviser can control improper questioning. A support need does not automatically prevent evidence from being tested; the aim is a fair method.

Use directions to protect fairness

Case management can deal with timetables, evidence, witness attendance, format, privacy and other procedural questions. Put each direction in a master calendar with a named owner. If compliance becomes impossible, seek a change before the deadline with supporting reasons and a realistic replacement date. Agreement between the parties may assist but does not necessarily vary a panel direction. Keep the formal ruling and circulate it to everyone responsible for preparation.

Before the hearing, reconcile the parties' bundles and identify duplicate, missing or illegible material. Prepare a chronology and issue list that cite final page numbers. Confirm remote links, interpreters and document access for every witness. These practical checks prevent technical failure from becoming evidential unfairness. At the hearing, maintain a record of admitted late documents, panel rulings and any changed allegation so final submissions address the case as actually determined.

Can a witness give evidence remotely?

TRA hearings are currently virtual by default, and guidance also addresses remote participation in in-person cases. The actual arrangement should be agreed or directed for the specific witness.

What happens if important evidence is found late?

Notify the other party and TRA promptly and make the required application. The panel considers relevance, reason for delay and fairness, including time needed for a response.
